The following terms and conditions apply to all services provided by Outcraft Studio to the Client.
The Client: The company or individual requesting the services of Outcraft Studio.
Outcraft Studio: Primary designer & developer.
The Project: Web design, software development, or other digital marketing related services being provided to the Client by Outcraft Studio.
Project Completion: Completion of components outlined in project breakdown.
Launch: Upload to the server or release of materials to the Client.
It is not necessary for any Client to have recorded an acceptance of these terms and conditions for them to apply. If a Client accepts a quote and subsequently pays a deposit, then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.
Please read these terms and conditions carefully. Any purchase or use of our services implies that you, the Client, have read and accepted our terms and conditions.
Outcraft Studio will carry out work only where an agreement is provided either by email, telephone, or in person. An ‘order’ is deemed to be a written or verbal contract between Outcraft Studio and the Client. This includes telephone and email agreements.
Please ensure that you read the project design, breakdown, quote, and terms and conditions contained in the agreement properly, ensuring that all details of the work are included, understood, and mutually agreed on.
Unless otherwise agreed upon with the Client, the timescale for completion of work can vary, depending on the scale of the work. Timeframes for the project will be discussed with the Client at the project start meeting before work on the project commences. Outcraft Studio will do their best to complete the project as soon as reasonably possible.
For a high standard of quality to be produced, please allow sufficient time for the project to be completed.
During the project, Outcraft Studio will require the Client to provide website content: text, images, movies, and sound files. Outcraft Studio is a small business and to remain efficient we must ensure that work we have scheduled is carried out at the relevant time. On occasions, we may have to reject other work offers to ensure that the Client’s work is completed at the time arranged.
In the interests of a smooth process, we ask that the Client provides all the required information and content to be supplied in advance of the project beginning.
If the required material and information are not forthcoming in the agreed time frame, then delays will inevitably result. If your project involves Search Engine Optimisation or Content Writing, we need to have the SEO & Content Writing Brief documents completed and returned in advance so that the work can be planned and completed efficiently.
If you agreed to provide us with the required information and subsequently find yourself unable to do so within the time frame agreed at the project start meeting, an account manager may contact you to offer further support services to help drive the project forward.
Please Note: Text content should be delivered as a Microsoft Word, email (or similar) document, with the pages in the supplied document clearly annotated as to which website pages they apply to. Contact us if you need assistance or clarification on this.
On completion of the website, the Client will have full access to their site’s content management system which will enable them to update the page content themselves. Training can be provided to support you with using your new content management system.
Unless otherwise specified in the project quotation, the Agreement assumes that any text for the website will be provided by the Client in electronic format, and that all photographs and other graphics will be provided electronically in .gif, .jpeg, .png, or .tiff format. Although every reasonable attempt shall be made by Outcraft Studio to return to the Client any images or printed material provided for use in the creation of the Client’s website, such return cannot be guaranteed.
Whilst every endeavour will be made to ensure that the website and any scripts or programs are free of errors, Outcraft Studio cannot accept responsibility for any losses incurred due to malfunctions occasioned by the Client making changes using the CMS system or any part of the website.
The website, graphics, and any programming code remain the property of Outcraft Studio until all outstanding accounts are paid in full.
Outcraft Studio cannot take responsibility for any copyright infringements caused by materials submitted by the Client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.
Any additions to the brief will be carried out at the discretion of Outcraft Studio. Where no charge is made by Outcraft Studio for such additions, Outcraft Studio accepts no responsibility for ensuring such additions are error-free; we also reserve the right to charge an appropriate amount for any corrections to these or further additions.
The Client agrees to make available as soon as is reasonably possible to Outcraft Studio all materials required to complete the website to the agreed standard and within the set deadline.
Outcraft Studio will not be liable for costs incurred, compensation, or loss of earnings due to the failure to meet agreed deadlines.
Outcraft Studio will not be liable or become involved in any disputes between the site owner and their Clients and cannot be held responsible for any wrongdoing on the part of a site owner.
Outcraft Studio will not be liable for any costs incurred, compensation, or loss of earnings due to the work carried out on behalf of the Client or any of the Client’s appointed agents.
Outcraft Studio will not be liable for any costs incurred, compensation, or loss of earnings due to the unavailability of the site, its servers, software, or any material provided by its agents.
Once a website has been designed and completed the hosting agreement will begin, and the first of the agreed monthly payments will be due. The amount may vary due to storage space, ongoing support time required, or website 3-month MOT requirements.
If the Client decides they no longer want the site once they have commissioned the work and paid a deposit, they are still obliged to pay for the work that has been done. Non-payment will result in legal action being taken if necessary. There are no exceptions to this.
Outcraft Studio will provide the Client with an opportunity to review the appearance and content of the website during the design phase and once the overall project development is completed, but before upload to a server or release of the materials to the Client.
The Client will be permitted a maximum of 3 (three) rounds of amendments during both phases of the website project. Any further amendments required outside of this allowance may incur charges at our standard hourly rate.
From the date of launch, the website will have a 30-day snagging period. In these 30 days we will fix any bugs or problems that arise free of charge. This does not include requests to add new content, imagery, or functionality.
Outcraft Studio cannot take responsibility for any losses incurred by the use of any third-party software programs, applications, and/or plugins used for the Client. Whilst every care has been taken to ensure products are problem-free and accurate, the ultimate responsibility lies with the Client in ensuring that all software is functioning correctly before use.
Where applications or sites are developed on servers not recommended by Outcraft Studio, the Client is expected to provide or seek any information, additional software, support, or cooperation pertaining to the server required in order for the application to be correctly developed. Where large applications are to be developed, Outcraft Studio will provide a suitable testing environment which is identical to the final production environment.
The Client is expected to test fully any application or programming relating to a site developed by Outcraft Studio before being made generally available for use. Where “bugs,” errors, or other issues are found after the site is live, Outcraft Studio will endeavour (but is not obliged) to correct these issues to meet the standards of function outlined in the brief within a three-month testing period.
If the Client requests design mock-ups of their project before the project commences, this service can be provided for an additional cost.
Any changes that need to be made to the project breakdown must be confirmed immediately by the Client and may be subject to additional charges.
Once the project is completed, any additional work required will be treated as a separate project and quoted accordingly.
Outcraft Studio will not be held responsible for any costs or expenses that may arise due to unforeseen circumstances or events outside of our control. These expenses are to be reimbursed by the Client.
Outcraft Studio makes every effort to ensure websites are designed to be viewed by the majority of visitors. Websites are designed to work with the most popular browsers (e.g., Firefox, Internet Explorer 11, Google Chrome, etc.). However, Outcraft Studio cannot guarantee correct functionality with all browser software across different operating systems.
Outcraft Studio cannot accept responsibility for web pages which do not display acceptably in new versions of browsers released after the website has been designed and handed over to the Client. As such, Outcraft Studio reserves the right to quote for any work involved in changing the website design or code for it to work with updated browser software.
Charges for services to be provided by Outcraft Studio are defined in the project quotation that the Client receives via email. Quotations are valid for a period of 30 days. Outcraft Studio reserves the right to alter a quotation or decline to provide the relevant service after expiry of the 30 days.
All prices quoted are estimates based on our understanding of the project requirements, as well as the scope of the project. Prices are subject to change depending on the final requirements of the project and third-party costs.
Outcraft Studio reserves the right to charge the Client for any additional costs incurred during the project. The Client agrees to pay for all international payment charges if applicable.
All payments are to be made within the terms specified on the invoice.
For projects with a total cost of £500 or less, full payment must be made before work commences.
For projects with a total cost of £1000 or more, the Client may choose to pay in instalments. Payment can be made in up to 11 monthly instalments with a minimum upfront payment of 10% of the total cost. Payments must be completed within the agreed timeframe.
Payment for third-party services, such as stock photography or website hosting, may be required upfront.
Delays caused by the Client do not extend the payment due dates.
All payments must be made by bank transfer, debit/credit card, or direct debit. Payment terms are specified on the invoice.
Invoices are due upon receipt unless otherwise specified. Invoices not paid within 30 days will incur a service charge.
Accounts unpaid 60 days after the date of invoice will be considered in default. If the Client’s account remains in default after 60 days, Outcraft Studio will, at its discretion, remove web pages or access to the project materials.
Outcraft Studio is not responsible for any loss of data incurred due to the removal of the service. Removal of such materials does not relieve the Client of the obligation to pay any outstanding charges. The Client agrees to cover any reasonable expenses incurred by Outcraft Studio in recovering the debt, including legal fees.
Once all payments are cleared, the rights to use the website pass to the Client. Rights to photographs, graphics, and third-party items remain with their respective owners.
Outcraft Studio retains ownership of all website design and code until all outstanding invoices are settled unless otherwise agreed upon in writing.
A link to Outcraft Studio will appear at the bottom of the Client’s website. Removal of this credit will incur a fee. The website may also be included in Outcraft Studio’s portfolio and marketing materials.
If the Client’s website is to be installed on a third-party server, Outcraft Studio must be granted temporary read/write access to the server directories. This access will be terminated once the project is complete.
Outcraft Studio cannot be held responsible for any issues with the website after migration to a new hosting provider.
Outcraft Studio cannot accept responsibility for any changes made to the website by third parties once installed.

These Terms and Conditions supersede any previous agreements. The Client’s signature or payment of an advance fee signifies acceptance of these Terms and Conditions.
